Who Will Get Custody Of Kristy And Desmond Scott's Kids? Know Details From Couples' Divorce Filings

Kristy and Desmond Scott were once the definition of modern-day love for millions of followers. The childhood sweethearts grew up together, built a family and turned their relationship into a viral social media brand. But the beautiful reality was marred after the couple announced their separation. After staying together for more than a decade, the influencer duo filed for divorce. However, the bigger shock came when the court documents revealed some deeply personal details about what went wrong and who will get what, which left the internet stunned.

Who will get the custody of Kristy and Desmond Scott's kids following their divorce? 

According to Kristy and Desmond Scott's official divorce filing in the court obtained by the US Weekly, the couple filed for divorce on December 30, 2025 in Harris County, Texas. In the petition, Kristy had mentioned infidelity as the cause behind the end of their marriage. Additionally, she stated that their marriage could not be saved due to the ‘discord’ or conflict of personalities. Although, she did not provide further details about the alleged affair in her petition, the file confirmed that they would soon live separately. 

Apart from their bond, the couple share two sons, Vance, 7 and Westin 6 who often appeared in their family content on social media. Now, in her filing, Kristy informed the court that she and Desmond planned to enter a written agreement about their custody, visitation and child support. However, if they would be unable to reach an agreement. She asked the court to make a decision on the same. Further, she revealed that they had signed a marital property agreement defining the division of their community and separate assets. She requested the court to enforce it. Lastly, she asked Desmond to cover her attorney fees and court expenses.

Desmond Scott broke his silence on his divorce 

After the news about their divorce became public, Desmond addressed the situation in a statement and shared it on his Instagram story on January 11, 2026. He apologized to Kristy, his family and everyone who was impacted by the public attention and acknowledged that Kristy would always be his priority as the mother of his kids. Alongside, he revealed that the couple were facing marital issues in 2025 and he had decided to ask for separation, but made some choices during the time that he wasn't proud of. In his words:

"Kristy and I faced challenges and made sincere efforts to work through them. Toward the end of 2025, I wanted to separate, and I had conversations with Kristy regarding this. During this period, I made choices that I am not proud of. I took responsibility for those actions, I shared this with her directly and personally, and ultimately we decided to divorce.”

Kristy and Desmond Scott's love story began long before they became famous on social media. The couple met in middle school at 14, and grew up together before they tied the knot in August 2014. Over the years, the couple built The Scott brand into a global content brand renowned for their couple pranks, family vlogs and lifestyle content. Meanwhile, they made their final joint appearance on social media in early December 2025, when Desmond posted a playful fashion-themed reel of Kristy that quickly went viral. Soon, their followers noticed that the couple stopped appearing on each other's social media handles hinting at something wrong before their fairytale came to a bitter end.
